How can I file a consumer complaint through CERC?
You can contact us via our website, email, toll free helpline number, or by visiting our office. We guide you through the process of filing your complaint and help escalate it if necessary.
Is there a fee to get help from CERC?
The initial complaint guidance is provided at no cost. However, a nominal fee of Rs. 200/- is applicable for the mediation procedure. This fee includes one year of unlimited complaint resolution through mediation and a subscription to our e-magazine Grahak Sathi.
What kind of complaints can CERC help with?
We assist with complaints related to:

How long does it take to resolve a complaint?
- For Mediation Process: 2 to 6 weeks (depending on the company’s response)
- For Legal cases: 6 months to 2 years (depending on the court’s schedule)
Can CERC help me if I’m outside Gujarat?
Yes. While we are based in Ahmedabad, CERC supports consumers across India.
What kind of consumer complaints can I approach CERC for?
You can approach CERC for assistance in matters involving deficiency in service or unfair trade practices by companies, service providers, or institutions. Common issues include health insurance claim denials, medical negligence, defective products, unjustified service charges, or non-refund of payments. CERC evaluates the legal merits of your complaint and helps you take it before the appropriate Consumer Commission.
Does CERC file consumer cases on behalf of individuals?
Yes. Under Section 2(5)(vi) of the Consumer Protection Act, 2019, a recognized voluntary consumer organization such as CERC can file complaints before Consumer Commissions on behalf of consumers or in a representative capacity. This allows collective or Public Interest Ligation (PIL) in cases affecting multiple consumers.
What is the role of the Legal Department of CERC in handling consumer grievances?
The Legal Department of CERC examines each grievance from a legal standpoint, determines whether it falls under the Consumer Protection Act, and advises the complainant about possible remedies. It also drafts, files, and argues consumer complaints before District, State, and National Consumer Commissions when CERC represents the complainant.
Are there any charges for legal assistance provided by CERC?
CERC provides legal support and representation at minimal or nominal fees, primarily to cover filing and administrative expenses. The objective is to make access to justice affordable and ensure that consumers are not deprived of their rights due to financial constraints.
How long does it take to resolve a consumer dispute?
The time frame depends on the nature of the dispute and the forum where it is filed. Simple cases may be resolved within a few months, whereas complex or higher-value matters may take longer due to procedural requirements. CERC ensures timely follow-up and compliance with all legal timelines to expedite the process as much as possible.
What are the documents required to file a consumer complaint through CERC?
Generally, you need to submit:
- A written complaint with details of the issue
- Copies of bills, invoices, or receipts
- Correspondence with the company/service provider
- Proof of identity and address
- Any expert opinion or report (if applicable)
CERC’s legal team reviews these documents and prepares the case as per the Consumer Protection Rules and procedure.
What kind of remedies can a consumer expect from the Consumer Commission?
The Consumer Commission may order refunds, replacement, compensation for loss or injury, removal of defects or deficiencies, or discontinuation of unfair practices. In cases of serious violations, the Commission can also award punitive damages or costs. CERC ensures that all possible remedies are effectively sought during legal proceedings.
What is the difference between filing a complaint through CERC and filing it directly before the Consumer Commission?
Filing through CERC provides the advantage of legal expertise, documentation support, and representation by an experienced team familiar with consumer jurisprudence. CERC ensures that your complaint is legally sound, properly drafted, and filed before the correct forum, thereby increasing the chances of effective redressal. When you file directly, you may have to handle legal formalities, drafting, and appearances on your own.
Can CERC help in enforcing the orders passed by the Consumer Commission?
Yes. The Legal Department of CERC assists consumers in execution proceedings if the opposite party fails to comply with the order of the Consumer Commission. This may include filing an execution application under Section 71 of the Consumer Protection Act, 2019, and taking steps for attachment of property or recovery of awarded amounts. CERC ensures that the legal remedy granted by the Commission is effectively implemented.
